释义	法律分析：一方向对方给付定金来担保他将来会履行合同义务。负有合同义务的人履行合同义务后，定金应当抵作价款或者收回。给付定金的一方不履行约定的合同义务的，无权要求返还定金；收受定金的一方不履行约定的合同义务的，应当双倍返还定金。法律依据：《中华人民共和国民法典》第四百六十九条当事人订立合同，可以采用书面形式、口头形式或者其他形式。
