问题	离婚都需要些什么条件
释义	我国法律规定准予离婚的以下法定理由：（1）重婚或者有配偶者与他人同居的；（2）实施家庭暴力或虐待、遗弃家庭成员的；（3）有赌博、吸毒等恶习，屡教不改的；（4）因感情不和而分居满2年的；（5）其他导致夫妻感情破裂的情形。其中第五项就是酌定情节，但是其导致感情破裂的程度仍然需要达到第一项到第四项情形的程度。另外须注意的是，如果一方是现役军人，如果不同意离婚，那么非军人一方不能提起离婚诉讼。法律依据《民法典》第一千零七十九条
