释义	法律分析：审理的时候是可以折算服刑期限的，管制刑期如果是羁押一天的话会抵扣刑期两天，如果属于拘役的话，一般是羁押一天抵扣刑期一天。在一审判决送达后，当事人有十天的上诉期，在这十天的上诉期届满前，一审判决尚未生效。法律依据：《中华人民共和国刑法》第四十一条管制的刑期，从判决执行之日起计算；判决执行以前先行羁押的，羁押一日折抵刑期二日。
