释义	法律分析：五证不全签订的认购书没有效。法律依据：《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》第二条出卖人未取得商品房预售许可证明，与买受人订立的商品房预售合同，应当认定无效，但是在起诉前取得商品房预售许可证明的，可以认定有效。《中华人民共和国民法典》第一百四十八条一方以欺诈手段，使对方在违背真实意思的情况下实施的民事法律行为，受欺诈方有权请求人民法院或者仲裁机构予以撤销。《中华人民共和国民法典》自2021年1月1日起实施。
