释义	根据刑法第237条的规定，行为人对不满14周岁的儿童实行猥亵的，构成猥亵儿童罪。本罪是行为犯，只要行为人对儿童实施了猥亵的行为，原则上就构成了犯罪，应当立案侦查。但是，对于情节显著轻微、危害不大的，可以按照刑法第13条的规定，不以犯罪论处。本罪的量刑标准是：构成本罪的，处5年以下有期徒刑或者拘役，从重处罚；聚众或在公共场所当众犯本罪的，处5年以上有期徒刑，从重处罚。
