释义	醉酒驾驶是指车辆驾驶人员在血液中的酒精含量大于或者等于每100毫升80毫克的情况下驾驶车辆的行为。如果醉酒驾驶机动车，则涉嫌危险驾驶罪，《刑法》第一百三十三条规定，一般会判处6个月以下拘役，并处罚金。醉酒驾驶机动车发生交通事故致人死亡的，以交通肇事罪定罪处罚。根据《刑法》第133条的规定，违反交通运输管理法规，因而发生重大事故，致人重伤、死亡或者使公私财产遭受重大损失的，处3年以下有期徒刑或者拘役。
