释义	法律分析：超过机动车驾驶证有效期一年以上未换证、被注销未超过两年的，通过科目一的考试后可恢复你驾驶证的正常使用果被注销超过两年的，则需要重新申领。所以逾期的话就要承担被注销的风险，新规规定，换证在当地的要提前90天进行手续的办理，当然也可以在异地进行相关手续的办理，但是要在该期限内，不能逾期也不能提前太久。法律依据；《机动车驾驶证申领和使用规定》第七十七条机动车驾驶人超过机动车驾驶证有效期一年以上未换证的车辆管理所应当注销其机动车驾驶证。
