法律分析：住房困难户可以申请安置房，无房户或人均居住面积不足30平方米的住房困难户，符合一户一宅政策，可以申请政府安置房，一对夫妇，含单亲家庭二人以上，包括二人为主要成员组成的家庭，无直系亲属的单身，二个以上成员的家庭，其中至少一人已成年，经房屋鉴定机构鉴定的危险等级属C级或D级的危房，计算人均居住面积时，无合法手续的部分应计算在内，每户家庭按人均50平方米享有安置房配售面积，所配售的安置房总面积按超过享有配售面积最小的原则控制，超过部分面积按商品房价格购买。村民拥有的旧房，经承诺无条件自行拆除，将原使用的旧宅基地交还村委会重新安排使用，其有合法手续的建筑面积部分实行拆一换一，不计差价。拥有旧产权证的村民，国土房产部门在为其办理安置房产权证时，须同时撤销旧的土地或房屋权证。安置房的定价参照经济适用住房的价格并结合拆迁安置重置价制定。
法律依据：《中华人民共和国国有土地上房屋征收与补偿条例》 第二十二条 因征收房屋造成搬迁的，房屋征收部门应当向被征收人支付搬迁费；选择房屋产权调换的，产权调换房屋交付前，房屋征收部门应当向被征收人支付临时安置费或者提供周转用房。
