释义	法律分析：对于实施全面两孩政策前违法出生的二孩是否要继续征缴社会抚养费，对于全面两孩政策实施之前，也就是2016年1月1号之前，违反法律法规规定生育第二个子女的，已经依法处理完成的应当维持处理决定，不能“翻烧饼”。《人口与计划生育法》第十八条规定，国家提倡一对夫妻生育两个子女。符合法律、法规规定条件的，可以要求安排再生育子女。《社会抚养费征收管理办法》第三条规定，不符合人口与计划生育法第十八条的规定生育子女的公民，应当依照本办法的规定缴纳社会抚养费。
