释义	单位要推翻工伤认定的话，可以申请行政复议；对复议决定仍不服的，可以提起行政诉讼。对工伤认定要异议，可以收到认定书60日内申请行政复议或者六个月内提起行政诉讼。六十日内提出行政复议申请；但是法律规定的申请期限超过六十日的除外。法律依据：《工伤保险条例》第三十一条社会保险行政部门作出认定为工伤的决定后发生行政复议、行政诉讼的，行政复议和行政诉讼期间不停止支付工伤职工治疗工伤的医疗费用。
