释义	欠信用卡钱会不会被起诉，由银行方自行决定。如果欠款的金额达到一万以上且经发卡银行两次催收后超过3个月仍不归还的，应当认定为刑法的“恶意透支”，涉嫌信用卡诈骗罪。恶意透支数额较大，在公安机关立案前已偿还全部透支款息，情节显著轻微的，可以依法不追究刑事责任。进行信用卡诈骗活动，数额较大的，处五年以下有期徒刑或者拘役，并处二万元以上二十万元以下罚金；数额巨大或者有其他严重情节的，处五年以上十年以下有期徒刑，并处五万元以上五十万元以下罚金。
