释义	法律分析：应该由被告现在的实际居住地法院管辖。原户籍地法院无权管辖。户籍所在地为住所。经常居地住时，是指居住一年以上的地方。如果一方不执行的是离婚协议中约定应给付的抚养费，另一方是不能直接向人民法院申请强制执行的，而必须要向人民法院提起民事诉讼，以原协议约定为证据，请求法院判令对方履行其应尽的义务。《民事诉讼法》第二十二条，对公民提起的民事诉讼，由被告住所地人民法院管辖；被告住所地与经常居住地不一致的，由经常居住地人民法院管辖。
