释义	法律主观：县级以上人民政府文物行政部门应当按照文物保护法规定的职权将本行政区域内具有相当历史、艺术、科学价值的不可移动文物，在征求所有人、使用人和相关主管部门意见后，分别确定为省级、市级和县级文物保护单位，报同级人民政府核定公布，并依法报上级人民政府备案。上级人民政府文物行政部门可以选择下级文物保护单位或者其他不可移动文物，确定为本级文物保护单位。文物行政部门选择的不可移动文物报请人民政府核定时，应当附具说明材料和专家意见。规模较大的文物保护单位应当制定专门的保护规划。
