释义	再婚后有一方去世婚前财产的分配方式一般情况下，该婚前财产应当认定为逝者的个人财产，不得认定为夫妻共同财产进行分割。应当按照遗赠协议优于遗嘱，遗嘱优于法定继承进行继承。如果双方约定或法律规定，该财产属于共同财产的，应当按照约定或判决分配。再计算出逝者个人财产，按照前述规则进行继承。《中华人民共和国民法典》第一千一百二十三条继承开始后，按照法定继承办理；有遗嘱的，按照遗嘱继承或者遗赠办理；有遗赠扶养协议的，按照协议办理。该内容由陈亚楠律师和点行律询共创回答
