释义	根据《合同法》第六十六条规定，当事人互负债务，没有先后履行顺序的，应当同时履行。一方在对方履行之前有权拒绝其履行要求。一方在对方履行债务不符合约定时，有权拒绝其相应的履行要求。同时履行抗辩权的适用条件或情形为：1、由同一双务合同产生的互负债务，且双方债务有对价关系。2、债务同时到期，可以同时履行；双方的对等给付是可能履行的义务。3、当事人一方的履行不符合约定，即瑕疵履行的另一方可对有瑕疵的履行部分行使抗辩权。
