释义	《关于建立犯罪人员犯罪记录制度的意见》第四条规定了未成年人犯罪记录封存制度，也即：对于犯罪时不满十八周岁，被判处五年有期徒刑以下刑罚的未成年人的犯罪记录，应当予以封存，准确地说应是未成年人轻罪犯罪记录封存制度《刑法》第一百条依法受过刑事处罚的人，在入伍、就业的时候，应当如实向有关单位报告自己曾受过刑事处罚，不得隐瞒。《刑法修正案八》第十九条在刑法第一百条中增加一款作为第二款：“犯罪的时候不满十八周岁被判处五年有期徒刑以下刑罚的人，免除前款规定的报告义务。”
