释义	应当至少具备两个条件：1、基于当地风俗习惯，并以订立婚约为前提条件和基础。如果男女双方没有婚约，或当地没有给付彩礼的风俗习惯，那么双方之间发生财物给付行为就不是彩礼，而是一般的赠与行为。2、彩礼的价值按照当地生活水平属于数额较大。如果给付的是价值较小的物品或少量现金，比如见面礼，目的在于增进感情，则不能认定为彩礼。
