释义	发回重审还可以提管辖权异议吗发回重审案件原则上是不可以提出管辖权异议的，但在下列条件都满足的情况下应允许被告提出管辖权异议:原审程序有误或者原审程序及事实都有错误;发回重审是由原审法院程序有误引起的;程序错误与管辖权异议有必然的因果关系。《关于适用审判监督程序若干问题的解释》第29条第一款规定，原审法院对该案没有管辖权的，不得指令原审法院再审。民事诉讼法》第207条的规定，再审程序一旦发动，即恢复到之前一审的程序中，应当按照一审的要求重新给被告送达应诉材料，允许被告提出管辖权异议。
