释义	刑事抗诉，是指人民检察院在认为刑事判决或裁定确有错误的情况下，按照法定诉讼程序，要求人民法院对案件进行重新审理并作出改判的法律监督活动。抗诉是启动二审和审判监督程序的条件之一。二审抗诉是针对地方各级人民法院尚未发生法律效力的判决、裁定提起的，而再审抗诉的对象是已经发生法律效力的判决和裁定，并无审级要求。判决或裁定在事实认定错误、法律适用错误，诉讼程序违法等情况下都有可能被认定为“确有错误”，例如证据未经质证却作为定案的依据、庭审过程不允许被告人陈述辩解等。
