代购奢侈品犯法吗

释义

法律主观：

代购不等于违法，其实有两种形式的代购是合法的：一种是本人从国外购买不超过一定价值和数量的物品，供自己使用或馈赠亲朋;另一种是专门的代购商家进行代购，但这些商家的物品是按法律交税的。

法律客观：

《海关法》第四十六条规定：“个人携带进出境的行李物品.邮寄进出境的物品，应当以自用、合理数量为限，并接受海关监管。”
