释义	法律分析：全部或者部分使用政府投资的建设项目，按工程价款结算总额5%左右的比例预留保证金。合同条款中对涉及质保金的下列事项最好事先进行约定，质保金预留比例、返还期限及方式，质保金是否计付利息，如计付利息，利息的计算方式，具体的保修范围、缺陷责任期的期限及计。法律依据：《中华人民共和国建设工程质量保证金管理暂行办法》第二条本办法所称建设工程质量保证金是指发包人与承包人在建设工程承包合同中约定，从应付的工程款中预留，用以保证承包人在缺陷责任期内对建设工程出现的缺陷进行维修的资金。
