释义	法律分析：提起行政诉讼或申请者行政复议后，重新作出行政处罚决定的，不得加重原告的义务或者减损原告的权益，也就是不得加重处罚。法律依据：《中华人民共和国行政处罚法》第七十七条行政处罚明显不当，或者其他行政行为涉及对款额的确定、认定确有错误的，人民法院可以判决变更。人民法院判决变更，不得加重原告的义务或者减损原告的权益。但利害关系人同为原告，且诉讼请求相反的除外。
