释义	法律分析：一般来说，材料款和工程款是两个不同的概念。这跟合同中规定的承包方式有直接的关系，合同中若是所有材料都是甲供，那工程款就是清包工的人工费及其他费，这就是清包工；若是合同中规定的材料是乙方供，即施工方负责材料，这就是包工包料，工程款就含有材料费。法律依据：《中华人民共和国建筑法》第十八条建筑工程造价应当按照国家有关规定，由发包单位与承包单位在合同中约定。公开招标发包的，其造价的约定，须遵守招标投标法律的规定。发包单位应当按照合同的约定，及时拨付工程款项。
