释义	认定本罪的关键是这种行为是否经过批准。如果经过文化行政管理部门的批准，就是合法行为；反之构成犯罪。国有博物馆、图书馆以及其他国有单位，违反文物保护法规，将收藏或者管理的国家保护的文物藏品出售或者私自送给非国有单位或者个人的，依照刑法第三百二十七条的规定，以非法出售、私赠文物藏品罪追究刑事责任。法律依据《最高人民法院、最高人民检察院关于办理妨害文物管理等刑事案件适用法律若干问题的解释》第七条
