释义	不存在。我国现行有效的法律明确规定，夫妻一方死亡后，他们的婚姻关系自动归为终止。此时，一方当事人可以向法院申请宣告夫妻另一方死亡，在法院宣告之后，夫妻关系即为终止，生存下来的一方当事人可以自行婚嫁，不受限制。【本文关联的相关法律依据】《中华人民共和国民法典》第五十一条被宣告死亡的人的婚姻关系，自死亡宣告之日起消除。死亡宣告被撤销的，婚姻关系自撤销死亡宣告之日起自行恢复。但是，其配偶再婚或者向婚姻登记机关书面声明不愿意恢复的除外。
