《最高人民法院关于审理商品房买卖合d同纠纷案件适用法律若干问题的解释》第十八条的规定：
由于出卖人的原因，买受人在下列期限届满未能取得房屋权属证书的，除当事人有特殊约定外，出卖人应当承担违约责任；
商品房买卖合同的标的物为尚未建成房屋的，自房屋交付使用之日起90日;
商品房买卖合同的标的物为已竣工房屋的，自合同订立之日起90日。
二、房产证过户怎么办理
1、二手房房产证过户之前，需要进行房产交易的双方在合法的条件下签订购房合同，购房合同备案以后，双方开始进行房产过户手续。
2、到房产交易办理房产证过户手续，双方需要携带各自的身份证件及复印件，还要携带关于双方婚姻状况的证明，例如单身证明或是结婚证等，还有购房合同和房屋的相关产权证等资料。
3、进行房产交易登记以后，会进行网签，以前都是签书面合同，现在一般都实行网签了，不仅方便管理查询，房产交易的双方也节省了等待的时间，在网签后按照排号的日期，进行房产交易的下一步就可以了。
4、到税务局缴纳税费的时候，税费方面双方都是有费用的，出售房屋的一方如果享受了政策，基本就没有其他的什么费用了，就算需要缴纳其他的费用，数目也是比较少的。
5、手续都办理完毕以后，等到领证的时间一到，购房的一方拿着自己的相关证件就可以领证了。
