代销药品违法吗

释义

法律主观：

代购进口药品只要接受相关部门的监管，并取得《进口药品注册证》，且通过正常缴纳关税来代购，完全合法。如果代购过程中违反法律规定、逃避了海关监管、偷逃关税，则不论采取何种方式，都属于违法行为。

法律客观：

《中华人民共和国药品管理法》第三十九条药品进口，须经国务院药品监督管理部门组织审查，经审查确认符合质量标准、安全有效的，方可批准进口，并发给进口药品注册证书。医疗单位临床急需或者个人自用进口的少量药品，按照国家有关规定办理进口手续。
