释义	第一次如对方不同意离婚，也不满足离婚的法定情形且无法直接证明达到夫妻感情却已破裂的标准，一般判决不予离婚。而第二次起诉，一般法院视为双方夫妻感情确已破裂。法律依据：《中华人民共和国婚姻法》第三十二条对于起诉离婚条件的相关规定： (1)重婚或有配偶者与他人同居的; (2)实施家庭暴力或虐待、遗弃家庭成员的; (3)有赌博、吸毒等恶习屡教不改的; (4)因感情不和分居满二年的; (5)其他导致夫妻感情破裂的情形; (6)一方被宣告失踪，另一方提出离婚起诉的，应准予离婚。
