释义	法律分析：犯罪分子判处缓刑的，如果有先行羁押的，羁押期限是不能折抵缓刑期限的，判处管制、拘役、有期徒刑的刑罚才能折抵刑期。法律依据：《中华人民共和国刑法》第四十一条管制的刑期，从判决执行之日起计算;判决执行以前先行羁押的，羁押一日折抵刑期二日。第四十四条拘役的刑期，从判决执行之日起计算;判决执行以前先行羁押的，羁押一日折抵刑期一日。第四十七条有期徒刑的刑期，从判决执行之日起计算;判决执行以前先行羁押的，羁押一日折抵刑期一日。
