民法典关于赡养老人的规定 |

根据《民法典》规定父母不履行抚养义务的，未成年子女或者不能独立生活的成年子女，有要求父母给付抚养费的权利。成年子女不履行赡养义务的，缺乏劳动能力或者生活困难的父母，有要求成年子女给付赡养费的权利。子女不履行赡养义务时，无劳动能力的或生活困难的父母，可以直接要求子女付给赡养费的权利。如果子女拒不支付，也可以请求居民委员会、村民委员会以及所在单位调解，说服子女给付。如果子女不履行赡养义务时，无劳动能力的或生活困难的父母可以通过诉讼程序提出请求，人民法院应当根据父母的实际需要和子女的经济负担能力，通过调解或判决方式，确定赡养费数额和给付办法。对于被赡养人有生活来源，但因丧失劳动能力、生活不能自理而需要劳务扶助，起诉至人民法院的，法院也应当受理，从而促使义务人全面履行义务。义务人有能力赡养而拒绝赡养，构成遗弃，情节恶劣的，应依法追究其刑事责任。
法律依据：
《中华人民共和国刑法》 第二百六十一条 对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。该条是遗弃罪的具体规定。
