追诉期限与追诉时效 |

追诉时效和追诉期限是同一个意思，都是指刑事法律规定的，对犯罪分子追究刑事责任的有效期限。即对于不同法定量刑的犯罪，具有不同时间上的追诉时效，从而督促当事人行使权利，犯罪已过追诉时效期限的，不再追究刑事责任。追诉期限和追诉时效的区别：追诉时效是指按照刑法的规定追究犯罪或者侵权行为的有效期限。举报犯罪行为的时间已经超过法律规定的追诉时效期限的，不再追究其法律责任；如果已经被追究了法律责任，该案件应当予以撤销。刑事案件追诉时效的期限是根据各种犯罪法定刑的轻重，分别规定长短不一的追诉时效期限。
法律依据：《中华人民共和国刑法》 第八十七条 犯罪经过下列期限不再追诉：
（一）法定最高刑为不满五年有期徒刑的，经过五年；
（二）法定最高刑为五年以上不满十年有期徒刑的，经过十年；
（三）法定最高刑为十年以上有期徒刑的，经过十五年；
（四）法定最高刑为无期徒刑、死刑的，经过二十年。如果二十年以后认为必须追诉的，须报请最高人民检察院核准。
