释义	法律分析：只要是党员在逝世后向生前所在党组织申请得到同意后，均可在遗体和骨灰盒上加盖党旗，遗体上用3号或4号党旗。骨灰盒上用5号党旗，但党旗不能随遗体一起火化，也不能随骨灰盒下葬，通常逝者亲人留作纪念保留。法律依据：《关于全面做好规范中国共产党党徽党旗工作有关问题的通知》第五条各级党组织要按照规定使用党徽党旗，并妥善保管。党员去世后，经所在单位党组织同意，可以在其遗体或骨灰盒上覆盖党旗，但党旗不得随遗体火化或随骨灰盒掩埋。
