释义	1、需为男女二人之间。三人以上的同宿群奸是违法行为，不为本述的同居。男人与男人、女人与女人、中性人与中性人之间的同性恋，和男、女与中性人的同居也不包括在内。 2、需有包括性生活在内的共同生活。同居需有“三同”：同吃、同住、同性生活。没有性生活的共同居住不是本文的同居。仅有性关系，没有共同居住生活也不构成同居。法律依据：根据《中华人民共和国民法典》第一千零四十六条规定结婚应当男女双方完全自愿，禁止任何一方对另一方加以强迫，禁止任何组织或者个人加以干涉。
