释义	法律分析：年终奖的发放，劳动法律没有硬性规定，是否发放年终奖，属于单位的自主权。但如果劳动合同中有明确规定，或者单位的规章制度中对年终奖有明确规定，单位就应该按照约定或者规定发放。法律依据：《中华人民共和国劳动法》第五十条不得克扣或者无故拖欠劳动者的工资，对迟发年终奖的企业主应给予批评教育，严重的可按照第九十一条第一款规定，克扣或者无故拖欠劳动者工资的，由劳动行政部门责令支付劳动者的工资报酬、经济补偿，并可以责令支付赔偿金，以侵害劳动者合法权益情形论处。
