释义	法律分析：婚姻登记机关和人民法院查明确实是无效婚姻时，应当收回被骗取的结婚证，宣告该婚姻无效，解除当事人之间的同居关系，并对同居期间的财产及所生子女作适当处理。由于无效婚姻不具有婚姻的法律效力，所以，无效婚姻存续期间的财产不能认定为夫妻共同财产，只能按一般共有财产对待。就是指共有各方根据各自对共有财产的贡献大小按比例分享。法律依据：《中华人民共和国民法典》第一千零五十一条有下列情形之一的，婚姻无效：（一）重婚；（二）有禁止结婚的亲属关系；（三）未到法定婚龄。
