释义	法律分析：近亲是指直系血亲和三代以内的旁系血亲，由于近亲很可能从共同的祖先那里继承同一种隐性致病基因，因而近亲结婚会增大隐性遗传病的发病几率，禁止近亲结婚则可以减小遗传病的发病几率，但不能防止遗传病的发生。法律依据：《中华人民共和国民法典》第一千零四十八条直系血亲或者三代以内的旁系血亲禁止结婚。第一千零五十一条有下列情形之一的，婚姻无效：（一）重婚；（二）有禁止结婚的亲属关系；（三）未到法定婚龄。
