释义	法律分析：法人是组织，自然人只能担任法定代表人。受过刑事处罚能当法定代表人。但是因贪污、贿赂、侵占财产、挪用财产，或者破坏社会主义市场经济秩序，被判处刑罚，执行期满未逾五年，或者因犯罪被剥夺政治权利，执行期满未逾五年的人不能担任法定代表人。法律依据：《中华人民共和国公司法》第十三条公司法定代表人依照公司章程的规定，由董事长、执行董事或者经理担任，并依法登记。公司法定代表人变更，应当办理变更登记。
