释义	寄出的合同如果符合要约的要件，并且合同上面双方当事人并未都在上面签字的，合同的内容明确具体并希望与受要约人订立该合同的，该合同属于要约。如果不符合要约的条件，或者双方当事人要件在上面签字盖章了的，其不属于要约。法律依据：《民法典》第四百七十二条要约是希望与他人订立合同的意思表示，该意思表示应当符合下列条件：（一）内容具体确定；（二）表明经受要约人承诺，要约人即受该意思表示约束。
