释义	没有法定义务。我国现行的法律仅规定了子女及有负担能力的孙子女、外孙子女作为赡养人的赡养义务，赡养人的配偶不是法定的赡养人。虽然法律规定赡养人的配偶应当协助赡养人履行赡养义务，但协助的义务不是赡养义务，且此规定只适用于夫妇关系存续期间。【本文关联的相关法律依据】《中华人民共和国民法典》第一千零六十七条父母不履行抚养义务的，未成年子女或者不能独立生活的成年子女，有要求父母给付抚养费的权利。成年子女不履行赡养义务的，缺乏劳动能力或者生活困难的父母，有要求成年子女给付赡养费的权利。
