释义	夫妻有一方重病另一方不照顾，可以通过诉讼获得扶养费。情节恶劣，构成遗弃罪的，应当承担刑事责任。法律依据: 《中华人民共和国民法典》第一千零五十九条夫妻有相互扶养的义务。需要扶养的一方，在另一方不履行扶养义务时，有要求其给付扶养费的权利。第一千零九十一条有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：（一）重婚；（二）与他人同居；（三）实施家庭暴力；（四）虐待、遗弃家庭成员；（五）有其他重大过错。
