释义	法律分析: 违章建筑依其“违章”的程度不同，有各种不同的情况。从表面上看违章建筑建筑人有无土地使用权上说，违章建筑大体上可以分为两种：一是建筑人未取得土地使用权，因而也无法取得建筑许可证。二是在自己取得土地使用权的土地上建造违章建筑物，即虽有利用该建筑物占有范围内的土地建造房屋等建筑物的权利，但未经取得建筑许可证而擅自建设的建筑。法律依据: 《中华人民共和国行政处罚法》第二十九条第一款违法行为在二年内未被发现的，不再给予行政处罚。法律另有规定的除外。
