释义	一、欺诈罪和诈骗罪的区别是什么? (一)侵犯的客体不同。诈骗罪只侵犯财产所有权，是单一客体，而本罪既侵犯他人的财产权利，同时又侵犯合同行为管理制度。 (二)犯罪客观方面表现不尽相同。诈骗罪可以表现为虚构任何事实或隐瞒真相，以骗取财物;本罪只是在经济合同的签订、履行过程中，因而欺诈手段有特定范围的特殊性。 (三)犯罪主体不尽相同。诈骗罪限于自然人主体;本罪主体包括单位，且是任何单位。 (四)本罪与诈骗罪属于法条竞合，应当遵循特别法优于一般法的原则。
