【法律依据】:
《中华人民共和国刑法》 第二百五十八条 重婚罪有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。在法律上面，重婚和同居是两个不同的概念，当然具体的构成也是不同的。有配偶者与他人同居，是指有配偶者与婚外异性，不以夫妻名义持续、稳定地共同生活居住。禁止有配偶者与他人同居是修正后的婚姻法为保障一夫一妻制原则而新增加的禁止性规定。
