释义	法律分析：在普通赠与合同中的赠与人不承担损害赔偿责任，只有具有救灾、扶贫等社会公益、道德义务性质的赠与合同或者经过公证的赠与合同中的赠与人才可能承担损害赔偿责任；并且仅仅是在因其故意或者重大过失而致使赠与的财产毁损、灭失的情况下才承担该责任，也就是说，在因其轻过失而致使赠与的财产毁损、灭失的情况下，赠与人不承担损害赔偿责任。法律依据：《中华人民共和国民法典》第六百六十二条赠与人故意不告知瑕疵或者保证无瑕疵，造成受赠人损失的，应当承担赔偿责任。
