释义	法律分析：因民法总则施行后成立的合同发生的纠纷，如果合同法“总则”对此的规定与民法总则的规定不一致的，根据新的规定优于旧的规定的法律适用规则，适用民法总则的规定。法律依据：《中华人民共和国民法典》第四百六十四条：合同是民事主体之间设立、变更、终止民事法律关系的协议。婚姻、收养、监护等有关身份关系的协议，适用有关该身份关系的法律规定;没有规定的，可以根据其性质参照适用本编规定。
