释义	法律分析: 新单位或者人才中心开具调档函，通过邮寄或者由本人持函到原单位提取档案，交新存档单位。辞职时，单位会将档案密封、加盖骑缝章。辞职后，可以接受档案的地方包括：有工作的，由新单位存档或者在新单位集体存档的人才中心存放；没工作的，档案转回户口所在地区人才中心存放。法律依据: 《最高人民法院关于审理劳动争议案件适用法律若干问题的解释(二)》第五条劳动者请求用人单位办理人事档案移转手续产生的争议，经劳动争议仲裁委员会仲裁后，当事人依法起诉的，人民法院应予受理。
