免于刑事处罚是指被告人的行为构成犯罪，但因犯罪情节轻微，而判决免予刑罚的一种处罚。就是通常所说的定罪免责。免于刑事处罚，是我国人民法院审理刑事案件作出判决处理适用的一种形式。
免予刑事处罚有案底吗
免于刑事处罚也会有相关记录的，同时公安机关内部会做为资料保存，是有案底的。免予刑事处罚不等于没犯罪，只是因为犯罪情节轻微或者其他情节才免予处罚。它不同于无罪释放。所以，会有犯罪纪录。免于刑事处罚主要包括以下情形：
1、免予刑事处罚指因某些原因犯下罪行，需要刑事处罚，但因为自首或其他情节，导致不用接受刑事处罚。
2、比如某些政治人物有豁免权等。根据我国法律规定，不满14岁，是不需要负任何的刑事责任的。这个不是法律漏洞，而是法律的明文规定。
3、不满14岁的未成年人；
4、 情节显著轻微、危害不大，不认为是犯罪的；
5、犯罪已过追诉时效期限的。
法律依据：《中华人民共和国刑事诉讼法》第十六条
有下列情形之一的，不追究刑事责任，已经追究的，应当撤销案件，或者不起诉，或者终止审理，或者宣告无罪：
（一）情节显著轻微、危害不大，不认为是犯罪的；
（二）犯罪已过追诉时效期限的；
（三）经特赦令免除刑罚的；
（四）依照刑法告诉才处理的犯罪，没有告诉或者撤回告诉的；
（五）犯罪嫌疑人、被告人死亡的；
（六）其他法律规定免予追究刑事责任的。
