释义	法律分析：雇主的责任包括三个方面：1、雇工在执行职务中所受到损害，雇主承担侵权损害赔偿责任；2、雇工在执行职务中致第三人损害，雇主承担侵权损害赔偿责任；3、雇工在执行雇佣活动中，第三人致雇工损害，雇主应承担侵权损害赔偿责任。法律依据：《最高人民法院关于适用〈中华人民共和国民事诉讼法〉若干问题的意见》第四十五条个体工商户、农村承包经营户、合伙组织雇佣的人员在进行雇佣合同规定的生产经营活动中造成他人损害的，其雇主是当事人。
