释义	假药是指药品所含成份与国家药品标准规定的成份不符，或者以非药品冒充药品、以他种药品冒充此种药品的。劣药是指未标明有效期、生产批号、超过有效期的，或者直接接触药品的包装材料和容器未经批准、擅自添加着色剂、防腐剂、香料、矫味剂及辅料。生产、销售假药的，处三年以下有期徒刑或者拘役，并处罚金；对人体健康造成严重危害或者有其他严重情节的，处三年以上十年以下有期徒刑，并处罚金；致人死亡或者有其他特别严重情节的，处十年以上有期徒刑、无期徒刑或者死刑，并处罚金或者没收财产。
