法律分析：
如果劳动者是主动辞职的，是需要提前一个月以书面的形式通知用人单位的；如用人单位的行为是违反《劳动合同法》地38条规定情形之一的，劳动者是可以被迫辞职的，是不需要提前一个月的。
法律依据：
《中华人民共和国劳动合同法》 第三十七条 劳动者提前30天提出的书面离职，不需要用人单位批准就可以离职。其中，试用期提前3天书面提出；用人单位有义务结清工资办理离职手续。
